These Terms & Conditions ("Terms") govern your use of sesc.net and the services of Sports and Exercise Science Co. ("SESC," "we," "us"), including in-centre appointments and classes, memberships, our online store, and SESC University video subscriptions. By booking a service, placing an order, subscribing to SESC University, or otherwise using our website, you agree to these Terms.

About SESC and these Terms
SESC (Sports and Exercise Science Co.) is a sports medicine and performance centre based in Kuwait, operating physical therapy, performance development, recovery, nutrition, and sports psychology services, an online store, and SESC University. These Terms, together with our Privacy Policy, form the agreement between you and SESC. If you do not agree to these Terms, please do not book our services, place an order, or subscribe to SESC University.

Accounts and eligibility
To book a service, place a store order, or subscribe to SESC University, you may need to create an account and provide accurate, current information, including a valid name, phone number, and email address. You are responsible for keeping your login details confidential and for all activity under your account. Services for minors (including our youth athlete and pediatric programs) must be booked and consented to by a parent or legal guardian, who remains responsible for the account.

Bookings, appointments, and cancellations
Appointments and classes can be booked online through our booking system or by contacting us directly. We ask that you please give as much notice as possible if you need to cancel or reschedule.
- We recommend cancelling or rescheduling at least 24 hours before your scheduled appointment wherever possible.
- Late cancellations or missed appointments ("no-shows") may, at SESC's discretion, be subject to a cancellation fee or forfeiture of a pre-paid session, which will be communicated to you at the time of booking or via WhatsApp/email reminder.
- SESC will make reasonable efforts to notify you as early as possible if we need to reschedule a session due to practitioner availability or unforeseen circumstances, and will offer an alternative time at no extra cost.
- Repeated no-shows may result in a requirement to prepay for future bookings.

Memberships and subscriptions
SESC offers both facility memberships (for example gym and workout area access) and lighter subscription plans bundling services or benefits. Membership and subscription terms -- including price, billing frequency, and included benefits -- are set out at the time of purchase. Recurring memberships and subscriptions renew automatically at the end of each billing cycle unless cancelled by you before the renewal date through your account or by contacting us. Fees already charged for a current billing period are non-refundable except where required by law or expressly stated otherwise at the time of purchase. SESC may suspend or terminate a membership for non-payment or a breach of the Code of Conduct in Section 10.

Payments and pricing
Prices for services, memberships, store products, and SESC University subscriptions are shown in Kuwaiti Dinars (KWD) and may change from time to time; the price shown at checkout is the price that applies to your purchase. We accept payment via KNET, Visa, Mastercard, and American Express cards, Apple Pay, Google Pay, and Samsung Pay, and Deema (buy now, pay later, subject to Deema's own eligibility and terms), all processed securely by our payment partner Tap Payments and, for KNET, the KNET network. SESC does not store your full card details. You are responsible for ensuring your chosen payment method is valid and sufficiently funded; if a payment fails or is reversed, we may cancel the related booking, order, or subscription.

Store orders -- delivery and pickup
Physical products purchased from the SESC store are currently sold for delivery or pickup within Kuwait only.
- Delivery -- orders are delivered to the address you provide at checkout. A delivery fee, where applicable, is shown at checkout before you complete your order. Delivery is handled directly by SESC staff rather than a third-party courier network, so delivery windows are communicated to you after ordering and may vary with order volume and location within Kuwait.
- Pickup -- you may choose to collect your order from our centre; we will notify you by WhatsApp or email when it is ready.
- You are responsible for providing an accurate delivery address and being reasonably available to receive your order; SESC is not liable for delays caused by incorrect address details you provided.

Returns and refunds -- store products
If a store product arrives damaged, defective, or different from what you ordered, please contact us within 7 days of delivery or pickup with your order number and a description (and photo, where relevant) of the issue, and we will arrange a replacement, exchange, or refund at our discretion. Because of hygiene considerations, opened or used personal-care and wellness items cannot be returned unless faulty. Refunds are issued to the original payment method through Tap Payments or KNET and may take several business days to appear depending on your bank or card issuer.

SESC University -- courses and video subscriptions
SESC University gives subscribers streaming access to a library of instructional video courses for the duration of an active subscription. Access is personal to your account and may not be shared, resold, downloaded for redistribution, or used to create a competing product. Course content is provided for educational and training purposes and does not replace individualised guidance from a qualified practitioner. Subscriptions renew and may be cancelled as described in Section 4; cancelling stops future billing but does not refund the current paid period, and access continues until the end of that period unless stated otherwise at checkout. SESC may update, add to, or remove courses from the library over time.

Intellectual property
All content on sesc.net and within SESC University -- including videos, course materials, articles, graphics, logos, and the SESC name and branding -- is owned by SESC or licensed to us, and is protected by copyright and trademark law. You may not copy, reproduce, distribute, publicly display, or create derivative works from this content without our prior written permission, except for your own personal, non-commercial use while your account or subscription is active.

Code of conduct
When visiting our centre, using our website, or interacting with our staff, you agree not to:
- Provide false information when creating an account or booking a service.
- Behave abusively, threateningly, or disrespectfully toward SESC staff, practitioners, or other clients.
- Misuse our facilities or equipment in a way that creates a safety risk to yourself or others.
- Attempt to interfere with, hack, or disrupt our website, booking system, or store.
- Use SESC University content for any commercial or redistribution purpose.
SESC may refuse service, cancel a booking, or suspend an account where these standards are not met.

Medical and fitness disclaimer
SESC is a sports medicine and performance centre -- it is not a hospital, emergency medical provider, or a substitute for the advice of your physician. Our physical therapy, performance development, recovery, nutrition, and sports psychology services are designed to support fitness, rehabilitation, and performance goals under the guidance of our practitioners, based on the information you provide during intake and assessment. Physical activity and exercise carry an inherent risk of injury. You should consult a physician before beginning any new exercise, nutrition, or rehabilitation program, particularly if you have a pre-existing medical condition, injury, or are pregnant, and you should disclose relevant medical history and any physician instructions to our practitioners so they can plan your program appropriately. By using our services, you confirm that you are voluntarily participating and are responsible for promptly telling our staff about any pain, discomfort, or symptoms during a session.

Limitation of liability
To the fullest extent permitted by Kuwaiti law, SESC's liability for any claim arising from your use of our services, website, store, or SESC University is limited to the amount you paid for the specific service, product, or subscription giving rise to the claim. SESC is not liable for indirect, incidental, or consequential loss, or for any injury or complication arising from a pre-existing or undisclosed medical condition, from your failure to follow practitioner guidance, or from voluntary participation in physical activity generally. Nothing in these Terms limits any liability that cannot lawfully be limited or excluded under Kuwaiti law, including liability for gross negligence or wilful misconduct.

WhatsApp and electronic communications
By providing your phone number, you agree that SESC may contact you by WhatsApp (through our Resayil-based messaging platform), SMS, phone, or email regarding bookings, orders, subscriptions, and, where you have opted in, promotional updates. See our Privacy Policy for details on how WhatsApp communications are handled. You may opt out of non-essential messages at any time by contacting us.

Governing law and disputes
These Terms are governed by the laws of the State of Kuwait, without regard to conflict-of-law principles. Any dispute arising from these Terms or your use of SESC's services that cannot be resolved informally shall be subject to the exclusive jurisdiction of the competent courts of Kuwait.

Changes to these Terms
We may update these Terms from time to time to reflect changes in our services or legal requirements. The revised Terms will be posted on this page with an updated effective date, and continued use of our services after a change takes effect means you accept the revised Terms. Where a change materially affects an active membership or subscription, we will make reasonable efforts to notify you in advance.
